Welcome to Hari Ram Dilip Kumar (HRDK)! These Terms of Service ("Terms") govern your access to and use of the HRDK website, located at [Your Website URL, e.g., www.hrdk.in, and any services, products, features, content, applications, or software offered by HRDK (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

1.1. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Hari Ram Dilip Kumar ("HRDK," "we," "us," or "our"), a company [mention your legal entity type, e.g., incorporated under the laws of India].

1.2. Your access to and use of the Services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Services.

HRDK reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.

3. Account Registration and Eligibility

3.1. To access certain features of the Services, including wholesale pricing for non-silver products, you may be required to register for an account. You must be at least 18 years old or the age of legal majority in your jurisdiction to create an account.

3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. HRDK reserves the right to suspend or terminate your account if any information provided is inaccurate, not current, or incomplete.

3.3. You are responsible for safeguarding your password and for any activities or actions under your password. HRDK cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account and password.

4. Retailer Accounts and Wholesale Access

4.1. HRDK offers special "Retailer" accounts for approved wholesale partners.

 4.2. To apply for a Retailer account and gain access to wholesale pricing for our non-silver product ranges, you must first register a standard customer account.

4.3. Following registration, you must contact HRDK at admin@hrdk.in with your registered email, business details, and any required tax identification.

 4.4. HRDK reserves the right to approve or deny any Retailer account application at its sole discretion.

4.5. Once approved, your account will be tagged as a "Retailer," and you will be able to view wholesale pricing for applicable products when logged into your account. Wholesale terms, minimum order quantities, and payment conditions will be communicated separately and may be subject to a separate wholesale agreement.

5. Product Information and Pricing

5.1. Silver Products (B2C): Prices for our silver product collection are displayed directly on the website and are available for direct purchase by all customers.

5.2. Gold & Diamond (Non-Silver) Products (B2C Inquiry): For our gold, diamond, and other premium non-silver product collections, prices are not publicly displayed to general consumers. Interested customers are invited to use the "Inquire on WhatsApp" button available on each product page for a personalized inquiry.

5.3. Non-Silver Products (B2B Retailer Access): Approved and logged-in Retailer accounts will have direct access to wholesale pricing for our non-silver product collections.

5.4. HRDK strives to ensure all pricing information is accurate. However, in the event of a pricing error, we reserve the right to refuse or cancel any orders placed at the incorrect price.

5.5. Product images are for illustrative purposes only. While we endeavor to display accurate colors and details, the actual product may vary slightly due to screen settings, lighting, and natural variations in materials.

6. Orders and Payments

6.1. Order Acceptance: All orders placed through the Services are subject to HRDK's acceptance. We may, at our sole discretion, refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.

6.2. Payment: All payments for purchases are prepaid online. Cash on Delivery (COD) is not available. Payments are processed through secure third-party payment gateways. You agree to provide valid payment information and authorize HRDK to charge your selected payment method for the total amount of your order.

6.3. Shipping & Delivery: Shipping and delivery terms, including costs and estimated timelines, will be provided at checkout. Risk of loss and title for items purchased pass to you upon our delivery to the carrier.

6.4. Final Sale Policy: Please note that due to the nature of our products, all sales made through HRDK are final. We do not offer returns or exchanges, except in extremely limited circumstances for verified manufacturing defects, as detailed in our comprehensive Return and Refund Policy.

7. WhatsApp Inquiry Service

7.1. For non-silver products, HRDK provides an "Inquire on WhatsApp" service to facilitate direct customer communication.

7.2. By clicking the WhatsApp button, you consent to initiate a chat with HRDK's customer service via the WhatsApp platform. A pre-filled message containing the product name and code will be sent.

7.3. You acknowledge that communications over WhatsApp are subject to WhatsApp's own terms of service and privacy policy. HRDK is not responsible for the privacy practices or content of WhatsApp.

7.4. HRDK commits to responding to WhatsApp inquiries in a timely manner during business hours, but we do not guarantee immediate responses.

8. Intellectual Property

8.1. All content included on the Services, such as text, graphics, logos, images, product designs, and software, is the property of Hari Ram Dilip Kumar or its content suppliers and protected by international copyright laws.

8.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as generally permitted by the Services or with express written permission from HRDK.

9. User Conduct

9.1. You agree not to use the Services for any unlawful purpose or in any way that might harm, disable, overburden, or impair the Services or interfere with any other party's use and enjoyment of the Services.

9.2. You shall not attempt to gain unauthorized access to any portion of the Services, other accounts, computer systems, or networks connected to the Services, through hacking, password mining, or any other means.

10. Third-Party Links

Our Services may contain links to third-party websites or services that are not owned or controlled by HRDK. HRDK has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that HRDK shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. HRDK makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services. To the full extent permissible by applicable law, HRDK disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

12. Limitation of Liability

In no event shall HRDK, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

(i) your access to or use of or inability to access or use the Services;

(ii) any conduct or content of any third party on the Services;

(iii) any content obtained from the Services; and 

(iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.  

13. Indemnification

You agree to defend, indemnify, and hold harmless HRDK and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Services, by you or any person using your account and password; b) a breach of these Terms; or c) content posted on the Services.

14. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Jodhpur, Rajasthan, India without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Services shall be brought exclusively in the courts located in Jodhpur, Rajasthan, India.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

16. Entire Agreement

These Terms constitute the entire agreement between us regarding our Services, and supersede and replace any prior agreements we might have between us regarding the Services.
